Nelson : Commonwealth Attorney Announces Jury Conviction In Faber Drug Case

Press release verbatim received Thursday afternoon – Feb 1, 2018:

Thursday evening Daniel Rutherford, Commonwealth’s Attorney for Nelson County, announced that on January 30, 2018, a jury in Nelson County convicted Allen Thompson, age 63, from Faber, of possession of cocaine and possession of oxycodone. The jury recommended a total of 11 years incarceration for both charges.

The charges arose out of an incident that occurred during the winter of 2017 when deputies arrived at Thompson’s residence. Allen Thompson was sitting in a passenger seat of a vehicle and had a baggie of cocaine under his seat as well as oxycodone. At the residence, numerous drug paraphernalia and cocaine were found in a shed next to the residence.

Possession of a Schedule I or II controlled substance carries a maximum sentence of 10 years.
The jury deliberated for three hours before returning guilty verdicts. After further deliberation on sentencing, including evidence of the defendant’s previous convictions related to drug offenses, the jury recommended a sentence of six years for the possession of cocaine and five years for the possession of oxycodone.

Commonwealth’s Attorney Daniel Rutherford and Assistant Commonwealth’s Attorney Erik Laub prosecuted the case. Allen Thompson was represented by Samantha Freed and Daniel Zijerdi from Charlottesville, Virginia.

Formal sentencing is scheduled for 9:00 a.m. on April 9, 2018 in the Nelson County Circuit Court.

We first broke the news of a fatal train / truck crash just outside of Crozet, Virginia to you in this post yesterday on Wednesday – January 31, 2018.

The NTSB investigation continued Thursday afternoon, after yesterday’s fatal wreck of a GOP-chartered Amtrak train and a trash truck. A wrecker was on the scene waiting to haul off the truck and the trailer. The crossing at Lanetown remained closed as of early afternoon Thursday.

No word yet on when it will reopen so motorists should expect a detour.

Nelson : Roseland / Bryant : Suspicious Person(s) May Be Checking Homes

Today we were contacted by residents living in the Bryant area of a Nelson County about some suspicious activity that’s taken place over the past day or so. This may be someone trying to check houses to see if anyone is home and if not, burglarize the property. So far no actual break-ins are known of.

“Yesterday morning about 5:20 AM someone knocked on the door. My husband already left for work and the house was dark. I turned on lights and someone else in the house went down. He went all around the house, but saw no one,” one resident said.

A week or so earlier another neighbor in the vicinity reported they believe someone was in their house before they returned home. Their front doors, which bolt, were open along with the stormdoors which they keep locked.

The Nelson Sheriff’s Office was contacted and have stepped up patrols in the area. But anyone living in the Roseland / Bryant areas may want to keep an extra watch and let your neighbors know.

“According to police, the crash occurred near Marymart Farm Road and Lanetown Road, west of Crozet.”

We’ve been telling you about Richard’s Averitt’s battle against the Atlantic Coast Pipeline for over a year. Should the pipeline proceed, as projected, it will cross his land that runs along Route 151 between Spruce Creek and the Rockfish River.

Below in this short video interview Richard discusses where things currently are and what’s next.

Cutting of some trees along the pipeline path took place last week in adjoining Buckingham County.

On November 22, 2016, I was sworn in as the Commonwealth’s Attorney for Nelson County. It is important to let the citizens of Nelson County know the accomplishments of the Office of the Commonwealth’s Attorney for Nelson County. Over the next few weeks I will be providing a review of the accomplishments by my office for the last year. Last week’s review was on the accomplishments of prosecuting drug dealers. This review will be on the increased case load overall my office handles in the Nelson County Circuit Court.
I have made it a priority to work alongside all those in the law enforcement community to ensure that they have the legal support needed to investigate crimes within Nelson County. Our efforts have led to a vast increase in charges secured and a successful prosecution of such charges. The felonies charged and prosecuted during my first year in office represents the largest number for any 12-month period for the Nelson County Commonwealth’s Attorney Office.

From December 2016 through November 2017, which represents the first 12 months I was in office, the following are the numbers handled in the Nelson County Circuit Court:

• 516 felonies charges filed.
• 316 felony charges prosecuted, the remaining charges are pending trial.

From December 2015 through November 2016, prior to when I took office, the following are the numbers handled in the Nelson County Circuit Court:

• 239 felony charges filed.
• 168 felony charges were prosecuted, with the remaining were pending trial.

The ability to successfully prosecute the substantial increase in criminal felony trials my office has handled is because of the exceptional work of my Assistant Commonwealth’s Attorney Erik Laub, my legal assistants Debbie Giles and Dana Campbell, and my Victim Witness Advocate, Beth Cunningham. I am forever grateful for the dedication they have to the endeavor to seek justice and to keep Nelson County safe.

Tax Reform – What’s in it for Me?
Tax Cuts & Job Act Impact on Individual Taxpayers

The 2017 tax reform bill has created an entirely different playing field for taxpayers – this isn’t just a simple change in tax rates or rules. While the changes will not affect 2017 tax filings, taxpayers should make plans to discuss the impact on their individual situation with a tax professional as soon as possible.

What’s in the new rules? Lower tax rates, enhanced child credits and a larger standard deduction. There is also a special 20 percent reduction in taxable income for small business owners. This means that many taxpayers will pay less in federal income tax. Taxpayers that previously itemized their deductions will likely qualify for the larger standard deduction.

What’s not in the new rules? The tax bill eliminates exemption deductions for you and your family members, special deductions for moving expenses, and many itemized deductions – including limitations on tax payments, certain mortgage interest and employee business expenses.

Changes in the federal tax withholding calculations for employees may also result in insufficient withholding for some taxpayers. Adjustment to these withholdings as soon as possible is necessary to avoid a large balance due next year.

Rogers & Associates, provides clients with 2018 income tax projections as they prepare their 2017 returns and providing proactive recommendations. Early implementation of changes is encouraged. For example, taxpayers with a home equity line of credit (HELOC) should consider refinancing to a traditional mortgage since HELOC interest will no longer be deductible. Employees that traditionally have large travel or other work-related expenses should discuss the possibility of a reimbursement policy with their employer since these expenses will no longer be deductible.

We’ve spent the better part of the past week getting the final touches put on our first webcam in the BRL WeatherNow network that includes 5 different weather stations.

The first webcam that’s gone up is at The Ski Barn. That’s at the intersection of Route 151 & Route 664 heading up to Wintergreen Resort.

We put one of our weather stations there last year, and added the camera just this past week! It looks west toward the Blue Ridge Parkway and Three Ridges.

We still have a few more minor adjustments to make and it will eventually be embedded here on our homepage of BRL as well.

Amherst : 18 Year Old Killed In Traffic Accident In Lowesville

Virginia State Police Release on Tuesday afternoon – 1.23.18

At approximately 4:50 p.m. yesterday (Jan. 22), Virginia State Police were called to the scene of a fatal crash in Amherst County.

A 2003 Ford Focus was traveling south on Route 778 near the intersection of Route 627 when it crossed the center line and collided head-on with a 2013 Freightliner Columbia 120 tractor trailer.

The sedan driver – Kaylynn N. Gardner, 18, of Amherst, Va. – was pronounced dead at the scene. She was not wearing a seat belt at the time of the crash.

No charges were placed. The crash remains under investigation.
