Planning Commission Work Session : 8.6.09

PLANNING COMMISSION WORK SESSION
Thursday, August 6, 2009

Present: Ms. Philippa Proulx, Ms. Emily Hunt, Mr. Mike Harman, Mr. Mike
Tapager,
Ms. Linda Russell and Mr. Tommy Bruguiere (Board Liaison)

Commissioners discussed and considered additions and amendments to the
Zoning Ordinance as follows:

SMALL WIND ENERGY ORDINANCE – After discussion of the comments received
during the Public Hearing, Commissioners agreed to add lattice towers as a
use allowed by Conditional Use Permit in all districts. The directed staff
to develop a definition of a lattice tower for inclusion. Commissioners then
voted 6-0 to recommend adoption of Article 22. Small Wind Energy Ordinance.
The draft ordinance will now go to the Supervisors for review.

LOT SIZE REQUIREMENTS IN A-1 ZONING DISTRICT – The Board of Supervisors, at
the request of the Board of Zoning Appeals, referred the question of whether
a smaller lot size should be allowed in A-1 Districts if public
infrastructure is available. After discussion and noting that a two-family
detached dwelling is a permitted use by right in A-1, Commissioners directed
staff to add the following under “Division Rights and Area Regulations”:

“One two-family detached dwelling unit is permitted per lot with a minimum
lot size of 30,000 square feet if utilizing the Nelson County sewage
disposal system.”

Staff will return the draft to the Commissioners for consideration at their
regular August meeting.

RETAIL STORE, NEIGHBORHOOD – Ms. Proulx presented a survey of “historic
country stores” in Nelson (completed by a volunteer) noting that all of the
stores are in agricultural or business zoning districts with only two in
residential (R-1) districts. She reported that all of those in A-1 can
request conditional or special use permits for the commercial uses discussed
in the country store draft ordinance, plus additional uses. Ms. Proulx said
that those in B-1 districts already have commercial operations. She reported
that of those in R-1, one area has three listed – one has been a residence
for over 33 years; the second has not been a store for over 60 years; the
third is Arrington Mini-Mart which is still operating as a store with
activities there grandfathered; and the fourth is Anderson’s Store which is
suitable for rezoning to A-1 which would make the conditional and special
use options available for consideration. She said that there did not seem to
be a reason to create a new ordinance, noting that the draft was based on
Albemarle County’s where ordinances are stricter on historic country stores.
Commissioners voted 6-0 to forward a resolution to the Supervisors that
after review, no amendments regarding country stores are needed with the
reasons noted above.

COMMUNICATION TOWER ORDINANCE – Ms. Russell reviewed the primary changes
recommended by the committee as follows:

– Class I Towers – increased height from 80’ to 95’ with administrative
approval and appeal to the Board of Zoning Appeals instead of the Planning
Commission (as per state code);
– Class II Towers – from 95’ to 130’ with the same process as currently
used;
– Class III Towers – over 130’ by Special Use Permit granted by Supervisors
after a recommendation by the Planning Commission;
– Removal of Scenic Byway restrictions; and
– More specifics about co-location policy

Further discussion tabled for Commission review of the draft.

DAM BREAK INUNDATION ZONES – Mr. Boger presented a proposed amendment to
Subdivision Ordinance to add Section 4-9. He noted that the draft was
created by Mr. Payne (County Attorney) to meet the state code requirements
to establish a process for review (by the Department of Conservation and
Recreation) of a development proposed within the boundaries of a mapped dam
break inundation zone. Commissioners directed staff to prepare a resolution
of intent for the regular August Commission meeting.

WORK SESSION – Commissioners directed staff to schedule a work session for
August 13th, August 18th, or August 20th depending on Mr. Payne’s
availability so that he could provide a summary review of proposed
amendments to Sections 12, 13 and 16 of the Zoning Ordinance dealing with
major and minor site plans. Commissioners agreed to also review the draft
Communication Tower Ordinance at that session.

Meeting adjourned.

Present: Mr. Steve Crandall, Ms. Emily Pelton, Mr. Erwin Berry, Mr. Alphonso
Taylor,
Mr. Bennett Saunders, Mr. Greg Kelly

Absent: Mr. Natt Hall

PRESENTATION BY VIRGINIA EMPLOYMENT COMMISSION – Ms. Teresa Turner, Director
of the VEC Work Force Center in Charlottesville, reported that Nelson
County’s unemployment rate was 6.8% as of the end of June – lower than the
country as a whole and slightly lower than the state. She noted, however,
that the number of unemployed in Nelson has doubled since this time last
year and that the unemployment insurance payments going to Nelson residents
was $800,000 last year and $1.2 million in the first six months of this
year. Ms. Turner said that that increase in unemployment insurance payments
has a huge impact as unemployed max out their benefits and then apply for
county fall-back programs. She noted that the largest number (20%) of
Nelson unemployed are in the construction industry, followed by
approximately 17% in the “unknown” occupations and approximately 10% in
production.

Mr. Taylor reported that he is now employed as an outreach worker to help
those unemployed, including Nelson residents, with job development,
interviewing skills, and other job attainment skills during a five-week
process to get back into the work force. He said that he has not seen as
many using the services as he would like to see and is hoping to increase
usage. (Note: See NC Community Job Club under “Of Interest” at the end of
this report.)

Ms. Dottie Brown, a registered Business & Economic Development Specialist,
said that her position was created through the Federal Economic Stimulus
program to work with employers, new and existing, to update job orders and
create the new job orders. She said that her team is partnering with VEC and
re-employment specialists to bring all the components together to help
employers and those looking for work. Ms. Brown said that her team is
working training facilities and utilizing an interactive computer system to
match employers with job seekers.

Ms. Marilyn Carter, also a registered Business & Economic Development
Specialist, gave a central email address for business owners to obtain
information and assistance at businessresources@vec.virginia.gov and the
main VEC website for employers and those seeking jobs at www.vaemploy.com.
She said that the website is very user friendly.

TREASURER’S REPORT – Mr. Taylor reported total funds available as of June,
2009 as $121.098.16:
– $8,711.98 in an LGIP account;
– $100,000.00 in a BB&T CD; and
– $12,386.18 in a BB&T Checking Account

POINTS OF INTEREST MAP – Mr. Crandall reported that the map is not quite
ready for review but should be available at the next EDA meeting.

COMPENSATION – Mr. Taylor reported that county staff has asked that the
Authority consider receiving their EDA compensation quarterly rather than
monthly. Members voted 5-0 to authorize staff to change their compensation
to quarterly. Mr. Kelly asked staff to determine whether direct deposit is
available for the compensation.

FARMER’S MARKET – Mr. Saunders reported that the Lovingston Farmer’s Market
is struggling, with low participation from vendors and the public. He asked
whether the EDA would consider ways it might help support the market while
it builds. After discussion, members voted 4-0 (Mr. Saunders abstained due
to a family financial interest in the market) to fund up to $500.00 for ads
and/or banners to benefit the farmer’s markets in Nelson with ads to include
days, hours and locations for each and all advertising to be a part of the
Due Nelson campaign.

LOCAL FOOD HUB – Mr. Kelly reported that the EDA has been invited to tour
the facility. Members agreed to do so as part of a regular monthly meeting
in the future.

Meeting adjourned.

Nelson County, Virginia
After a stormy night in some parts of Central Virginia (mainly south and west of Nelson) skies will eventually become party sunny today as a frontal boundary moves to our south. Over the next day or so it will move back north across our area as a warm front putting us back into warmer-more humid air. Scattered storms will still be around today, but take a little break Friday. Scattered storms return briefly on Saturday only to retreat by Sunday with temperatures rising into the lower 90’s well into the extended forecast period.

Afton
Nelson County, Virginia

Earlier this week we talked about the hop harvest underway here in Nelson. For a county that’s been so accustomed to picking grapes, it’s now becoming commonplace to hear about the hop harvest at Nelson’s microbreweries. At Blue Mountain Brewery in Afton, it’s been a busy week as they pick their hops coming in as well. “We did a hand-select picking of the ready cones and then did our final cut-down harvest last Monday. The hand select hops went into a “harvest” edition of Full Nelson an hour after they were picked, and because of Virginia’s climate and our early season, we may lay claim to the first commercially available Northern Hemisphere “wet-hopped” harvest beer (New Zealand’s hops are already out and Sierra Nevada Brewing Co. does a “Southern Hemisphere” wet-hopped beer in the early summer). Our wet-hopped harvest edition Full Nelson will be out next week,” says Taylor Smack, co-owner and Brewmaster at BMB.

“The hops from our big harvest, the cut-down harvest, were dried at 140 degrees for 12 hours in several batches in our mash tun, which we’ve figured out how to use as an “oast-house” (hop-drying facility) so we can dry, vacuum seal and use the bulk of our hops in Full Nelson throughout the year,” Taylor adds. Incidentally we have a neat story about BMB canning their Full Nelson in our August 2009 issue our now. It’s on page 37, view online by clicking here.

Going to be some mighty good beer here in Nelson this year!
