Nelson : County Treasurer Announces Retirement After 30+ Years Of Service

“After more than three decades of commitment to the citizens of Nelson County, Angela Hicks will retire as Nelson County Treasurer effective August 1, 2024.

She was elected Nelson County Treasurer in November 2011. Prior to her career as Treasurer, Hicks served Nelson County in various roles within the county government. In 1990 she was employed as a counselor for the county’s summer recreation program. While continuing to serve in this capacity for the next two summers, she also worked part-time/as-needed for the Commissioner of Revenue.

Hicks began her career in the Treasurer’s office in April 1993, at the as a part-time office clerk. “I am forever grateful to J. Marvin Davis who started me on the journey that became a life-long service to a County and people I love.”

During her time as Treasurer, Hicks has been an active member in the Treasurer’s Association of Virginia serving as the Central District Chair, as well as Chair of the Certification Review Committee. In 2014 she achieved the designation of Master Governmental Treasurer from the UVA Weldon Cooper Center for Public Education and the Virginia Treasurer’s Association, the first for the Nelson County Treasurer’s Office. Under her direction, the Nelson County Treasurer’s office became accredited, for the first time, in 2015 and continues that accreditation to date. Under her leadership, two of the three deputies employed in the office have become certified as Master Governmental Deputy Treasurers.

VSP Investigating Fatal Crash in Nelson County

“Virginia State Police is investigating a one-vehicle fatal crash that occurred Friday (May 10, 2024) at 10:30 a.m. on Piedmont Road in Nelson County.

A 2000 Honda CR-V was driving northbound on Piedmont Road, near its intersection with Galilee Road, when the vehicle crossed the center line, ran off the road to the left, struck a tree, and overturned.

The driver, Harry B. Bare, II, 63, of Bedford, Va., was partially ejected and died at the scene. He was not wearing a seatbelt.

The crash remains under investigation.

As Wintergreen Fire & Rescue Chief Curtis Sheets told me this past Monday, “It’s not everyday, or even every year that you deliver a baby in the back of an ambulance.” But, that’s exactly what happened on April 23rd. It was the second time in less than 30 days they’d delivered a baby outside of a hospital setting. Last month one was delivered in the Food Lion parking lot. But this one was on the way to the hospital!

“Heath and Clay did an incredible job under very stressful circumstances. There was an obvious bond that bloomed between Heath and the new Mom. Joy and ecstasy seen in both of their faces. Though I had minimal contact with the mom, I felt an amazing bond with her also. She was so appreciative of the crew and Wintergreen Rescue,” Wintergreen F & R drive Doug Bramwell shared in an email to the staff at Wintergreen Fire & Rescue.

Other Wintergreen crew members that assisted with the delivery / transport but weren’t in the reunion pics, were Austin Arbaugh, Shane Wheeler, Amy Wood and Doug Bryant.

Chief Sheets told us the crew was about 5 minutes out from MJH when the baby was delivered.

“Dozens of staff were waiting for us at Sentara MJH, with family members embracing mom and baby. The whole hospital stopping what they were doing to congratulate the new Mom,” Bramwell continued.

Good Night Marilyn, Rest In Peace My Friend

I met Marilyn Shifflett of Nellysford many years ago. I can’t tell you exactly when, but it’s been over 10 of the 20 years we’ve lived here permanently. I didn’t really get to know Marilyn and become closer to her until the looming threat of the Atlantic Coast Pipeline (ACP) became a very real threat to majestic mountains of Nelson County. You can’t think about the ACP and the opposition to it without thinking of Marilyn Shifflett. She was a tireless crusader against the pipeline, and in the end, in great part to her efforts, Dominion finally gave up and pulled the plug on the ACP.

“She was such an incredible ally in the fight against the ACP, but also just an absolute gem for this county. And she somehow always seemed to approach the hardest fights with a smile and optimism. I loved working with her,” Richard Averitt told me Monday afternoon after learning of Marilyn’s passing. They worked side by side for years to defeat the ACP.

Marilyn didn’t single handly defeat the pipeline. But without her diligent research and opposition, I am not sure Dominion would have packed their bags and left so soon. She should have been a researcher for any news network in the country or any institution. She simply was that good.

Marilyn reminds me of another warrior for Nelson County that left us a few years ago, Kim Cash. Kim, Like Marilyn, was adamant about keeping the heritage and character of Nelson County fundamentally rural. Back in the day Kim was at every BOS meeting, every zoning meeting, and more. She kept meticulous minutes from each meeting and made them available on the then Rural Nelson website. Kim passed away back in 2019 Both Marilyn and Kim were pioneers that predated a lot of us. Kim was responsible for finally getting big trucks banned from Route 56 West (Crabtree Falls Highway) They always got stuck up there near Montebello. Marilyn was just as important in helping get the ACP stopped just a few years back.

Marilyn and I didn’t always agree politically. Far from it. But we both despised government waste and inefficiency. Anyone on the Nelson BOS knew better than to go to war with Marilyn. She always had her homework done long before coming to a meeting. Years later we joined forces in a campaign. When Marilyn committed, she committed. And she wasn’t afraid to speak her mind. Ever.

Which brings me to the sad part of this story. Saying goodbye to Marilyn, forever. She passed away this morning, Monday – May 6, 2024, at her home. I won’t be passing that cute green house of hers just north of Nellysford anymore wondering what Marilyn’s up to these days in retirement. She finished off her work years not terribly long ago at Martin’s over in Waynesboro. She was freed up, finally, to do more of what she wanted with grandkids and such.

Some weeks ago I was taken into confidence by a mutual friend of mine and Marilyn’s. We were at lunch and she confided to me the end was near for Marilyn. She’d enter hospice. An aggressive cancer was attacking her. Through her tears she poured her heart our to me about how sudden this was and how devastated she was that her friend would soon be gone. I was shocked. I always thought Marilyn would be around for years. I’d be able to text or phone and get some info from her about this or that. But like so many I’ve had to write about since moving to Nelson two decades ago, Marilyn is gone.

I cannot overstate how important this woman was in keeping what all of us enjoy here in Nelson pristine. Again, Marilyn wasn’t the only person that stopped the ACP, but without her that chore would have been far more difficult.

There won’t be a funeral service for Marilyn, but the family says there will be a Celebration of Life ceremony in the future.

Thank you Marilyn for making me think more, become a better debater, and friend.

Sleep in peace Marilyn and fly high. You made a difference.

NELSON : Afton : VSP Investigating Single-Vehicle Fatal Crash

“Virginia State Police is investigating a fatal single-vehicle crash that occurred at 6:40 p.m. Sunday (May 5, 2024) on eastbound Afton Mountain Road in Nelson County.

A 2005 Chevrolet Tahoe was traveling east on Afton Mountain Road near Williams Creek Lane when it ran off the right side of the road. The vehicle continued into a ditch where it struck a culvert and overturned.

The driver of the Tahoe, Phillip R. Pugh, 65, of Afton, Va., died at the scene. He was not wearing a seatbelt.

The crash remains under investigation.

“ The privately owned, twin-engine 1975 Rockwell Aero Commander 690A was being piloted by John W. Latham, 63, of Haymarket, Va.. Neither Latham nor his passenger, Niiben C.A. Ayivorh, 73, of Burke, Va., survived the crash. Their remains were transported to the Office of the Chief Medical Examiner in Richmond for examination and autopsy.

The aircraft left the Manassas Regional Airport Sunday morning and was flying to the Georgetown, S.C. County Airport. There was a light rain at the time of the crash.”

“At 8:54 a.m. Sunday (May 5, 2024), the Fluvanna County Sheriff’s Office received a 911 call from residents living within the 200 block of Miles Jackson Rd. in Palmyra concerning a low-flying plane and then what sounded like an explosion. The Fluvanna County Sheriff’s Office, Virginia Conservation Police and Virginia State Police responded to search for wreckage and located the aircraft, which was on fire, in a densely wooded area off Miles Jackson Rd.

The Palmyra, Fork Union, Kents Store and Lake Monticello Fire Companies responded to the scene to attend to extinguish the fire and assist law enforcement. Fluvanna County Emergency Services also responded to the scene.

State police has confirmed that both occupants of the privately-owned, twin-engine aircraft did not survive the crash. State police is still in the process of notifying the next of kin of the pilot and passenger.  Both bodies are being transported to the Office of the Chief Medical Examiner in Richmond for examination and autopsy.

The aircraft left the Manassas Regional Airport this morning and was flying to South Carolina. There was a light rain at the time of the crash.

The cause of the crash remains under investigation at this time by state police, the FAA – which is currently on scene, and the NTSB.

“Just before 9 a.m. Sunday (May 5, 2024), Virginia State Police was alerted to a plane crash in Fluvanna County. Debris from the small, private aircraft was located in a wooded area within the 200 block of Miles Jackson Rd in Palmyra. The impact of the crash caused parts of the aircraft to catch fire. There is one confirmed fatality.

The crash remains under investigation at this time. Both the NTSB and FAA have been notified.

Nelson Sheriff & Agencies Make Significant Drug Arrest / Seizure

From Nelson County Sheriff’s Office:

“The Nelson County Sheriff’s Office, along with assistance from the Virginia State Police Interstate Criminal Enforcement Unit and the 3A Regional Drug and Gang Task Force, have been actively investigating multiple individuals for the distribution of Fentanyl, Methamphetamine, and Cocaine in the Central Virginia area.  During the course of the investigation, it was discovered that one individual, Mr. Demarcus Brown, was traveling out of the area to purchase large quantities of illegal narcotics before transporting these narcotics back into the Commonwealth of Virginia.  On May1, 2024, these investigative efforts resulted in a traffic stop in Nelson County, Virginia. As a result of this traffic stop, multiple Search Warrants were obtained and executed in the Greater-Charlottesville, Virginia, area.

The aforementioned Search Warrants resulted in the seizure of $8,000.00 in U.S. Currency, $370,000.00 in Cocaine, $34,000.00 of Methamphetamine, $2,300.00 in Fentanyl, $23,000.00 in Mushrooms, $34,000.00 in Marijuana, (2) Pistols valued at $750.00, and (2) Rifles valued at $1,500.00.

Mr. Demarcus Brown, a 48-year old male from Charlottesville, Virginia, was taken into custody and charged with the following criminal offenses:

  • Distribution of a Schedule I/II Narcotic (Second or Subsequent Offense)
  • Possession of a Firearm by a Violent Felon
  • Possession of a Stolen Firearm
  • Possession of a Firearm While in Possession of a Schedule I/II Narcotic

At this time, additional charges are pending as this case remains an active criminal investigation.  Mr. Brown is being held without bond in the Albemarle-Charlottesville Regional Jail (ACRJ).

Sheriff Embrey would like to thank all agencies who participated and provided resources during this extensive investigation.  The 3A Regional Drug and Gang Task Force is comprised of members of the Albemarle County Police Department, Charlottesville Police Department, Drug Enforcement Administration (Charlottesville Post), Fluvanna County Sheriff’s Office, Green County Sheriff’s Office, Nelson County Sheriff’s Office, University of Virginia Police Department, and the Virginia State Police.”

(NEW) Bridge superstructure repairs/replacement – Expect lane and should closures in the following areas:

  • Route 20 (Scottsville Road), temporary traffic signal with new traffic pattern at Route 708 (Red Hill Road). Route 708 is narrowed to one lane for construction on the bridge over the North Fork Hardware River in the southbound lanes. Drivers can also expect lane closures up to 10 minutes May 1 between 10 a.m. and 2 p.m. for steel beam setting. Please expect delays and backups. Project completion date, Dec. 2024.
  • Route 671 (Davis Shop Road), road closed between Route 601 (Free Union Road) and Route 664 (Markwood Road) starting Monday. Please follow signed detour around the work area. Crews are replacing part of the bridge. Project completion date is June 7.

LYNCHBURG, Va. – Highway work requiring road/lane/structure closures is planned;

however, work may be delayed/canceled due to weather or other issues. Items in

italics contain new/updated information. For up-to-date information, call 511 or visit

Crews will perform various activities throughout the district to include, but are not

limited to bridge & guardrail maintenance, brush/tree/limb cutting, pothole/surface/

shoulder work, surface treatment/paving operations, work orders, mowing, boom

axing, drainage repairs/ work and roadside cleanup.

Amherst County:

Route 29 & Route 151 (Patrick Henry Hwy.) – Construction of a Restricted Crossing U-

Turn, storm drainage, advanced warning flashers, traffic lighting. The Route 608

(Toytown Rd.) crossover is closed for Phase One of construction. Estimated reopening

of crossover July 2024. Use caution and watch for changes in the traffic pattern during

construction. Estimated project completion November 2024.

Route 131 (Old Courthouse Rd.) from Route 460 BUS (Confederate Blvd.) to Route

460 Bypass (Richmond Highway) – Route 131 Reconstruction. Traffic shift in place.

Route 610 (Spencer Rd.) – Bridge Railing Repair. Road closed. Detour in place.

Charlotte County:

Route 15 (Farmville Highway) at Route 15/360 BUS (Four Locust Highway) –

Roundabout project. Change in traffic pattern now in place allowing two-way

movement along Route 15/360 BUS (Four Locust Highway) and a stop condition for

Rte. 15 (Farmville Highway) southbound traffic. The on-ramps from Route 15 to the

Route 15/360 (Kings Highway) and the off-ramp from Route 15/360 (Kings Highway) to

Route 15 are closed to traffic. Message boards and detour signage will alert motorists

to the change and direct traffic along the detour. Estimated overall project completion

October 2024.

Cumberland County:

Route 45 (Cartersville Rd.) at Route 690 (Columbia Rd.) – Roundabout Project. Speed

limit has been reduced to 35 mph through the work zone. Shoulder and lane closures

expected. Use caution. Estimated completion November 2024.

Halifax County:

Route 360 (James D. Hagood Highway) from Route 716 (Wolf Trap Rd.) to Route 344

(Scottsburg Rd.) – Safety improvements. Shoulder widening, rumble strips, guardrail

replacement. Lane closures expected. Use caution. Estimated completion November

2024.

Route 501 (L P Bailey Memorial Highway) at Route 628 (Chestnut Road) – Intersection

improvement project. Shoulder and lane closures expected. Beginning May 6,

temporary traffic signals will be installed and be in place until approximately the end of

August, 2024. Use caution. Estimated overall project completion December 2024.

Route 645 (State Shed Rd.) – Culvert repair – Route 645 is closed. Detour is in place.

Estimated completion May 31, 2024

Route 29, between Route 6 (River Rd.) and Route 718 (Mountain Cove Rd.) –

Shoulder widening, rumble strip installation, guardrail installation. Work to begin March

18 and cause alternating lane closures. Estimated completion January 2025.

Route 60 (Richmond Highway) over James River – Bridge deck replacement. Lane

closures and changes in traffic patterns in effect. Traffic is utilizing the other side of the

bridge to cross. Estimated completion July 2024.

Route 641 (Sugar Barbour Rd.) – Culvert replacement. Route 614 is closed. A detour is

in place. Estimated completion June 7, 2024.

Route 665 (Worsham Road) – Bridge Replacement. Route 665 (Worsham Road) is

closed to through traffic from Route 15 (Farmville Road) to the intersection of Route

630 (Redd Shop Road). A detour with signs is in effect, using Route 15 to Route 628

(Granite Falls Blvd.) to Route 630 (Oak Ridge Road) back to Route 665. Estimated

completion May 31, 2024.

VDOT Schedules Citizen Information Meeting for Route 11 Corridor Improvements

The Virginia Department of Transportation will hold a Citizen Information Meeting concerning proposed improvements to the Route 11 (Lee-Jackson Highway) corridor in Augusta County. The open-house meeting will take place Wednesday, May 15, 2024, between 4 p.m. and 6 p.m. in the Dairy Barn Lecture Hall at the Frontier Culture Museum, 1290 Richmond Avenue, Staunton, VA 24401.

Citizens can come in anytime during the meeting hours and discuss the project on a one-on-one basis with VDOT officials and designers. Written comments can be submitted at the meeting or within 10 days after the meeting date to Scott Alexander. P.E., Project Manager, Virginia Department of Transportation, 811 Commerce Road, Staunton, VA 24401-9029.

The purpose of this project is to improve operational safety for the Route 11 corridor from the intersection with Route 1049 (Rolling Thunder Lane), through the interchange with Route 262, to the intersection with Barterbrook Road near the southern city limits of Staunton. This portion of Route 11 currently has two through-lanes in each direction and a two-way left-turn lane in the center of the roadway.

Between Rolling Thunder Lane and Barterbrook Road the project will replace the center turn lane with raised medians that allow left turns only at designated median openings. Most of the commercial access driveways and side streets will be restricted to right turns in and out between Payne Lane and Barterbrook Road. This will reduce crashes by restricting the number of conflict points onto Route 11. The project proposes minor lane modifications between Rolling Thunder Lane and Frontier Drive.

The project will construct a sidewalk on the eastern side of Route 11 from Frontier Drive to the existing sidewalk near the Staunton city limits. Multimodal improvements also include crosswalks, ADA-compliant facilities, and traffic signal modifications.

A Strategically Targeted Affordable Roadway Solutions (STARS) study of Route 11 from Rolling Thunder Lane to Commerce Avenue in the city of Staunton was completed in 2018. This segment of Route 11 in Augusta County was included in the study. The recommendations for operational and safety improvements were submitted by Augusta County and funded in the 2020 SMART SCALE Round 4.

In 2022 this segment of Route 11 had an average traffic county of 12,127 vehicles per day. By the design year of 2048 the estimated daily traffic volume is 13,700 vehicles per day.

The total estimated cost of this project is $3,344,819 which includes $607,708 for preliminary engineering, $665,359 for right of way acquisition and utility relocation, and $2,071,752 for construction.

News Bulletin : Former Nelson Emergency Coordinator Found Guilty On 18 Counts Of Sex Crimes W/Minor

As BRL first told you Tuesday night in this post below, former Nelson County Emergency Services Coordinator, Ray Uttaro, has been convicted by a jury on 18 counts of sexual crimes against a minor.

Nelson County Commonwealth Attorney Daniel Rutherford confirmed the convictions Tuesday evening after the jury deliberation that only lasted a few hours before coming back with the unanimous verdict.

Rutherford’s office made this formal release on the trial.

“Uttaro was convicted in a jury trial that spanned two days. The jury found Uttaro guilty of four counts of aggravated sexual battery of a minor; four counts of distributing oxycodone to a minor; four counts of sodomy of a minor; two counts of object sexual penetration
of a minor; two counts of carnal knowledge of a minor; one count of abduction
with intent to defile a child under the age of 16; and one count of sexual battery of
a minor. These crimes occurred while the victim was 11 through 15 years old.

“My office shall vigorously prosecute every sexual offense of a minor. I am
grateful for the dedication of my Victim’s Witness Advocate, Beth Phelps, and for
the hard work of Sheriff Mark Embrey and the Nelson County Sheriff’s Office.
Most important, it took a tremendous courage on behalf of the victim to come
forward and testify before the jury.”

You may remember Uttaro was embroiled in another scrape with the law back in 2011 where he accused of stealing a TV donated to the county. He eventually plead guilty to misdemeanor embezzlement in March 2012 while employed with the county.

Ray Uttaro will face sentencing on August 8, 2024 for the most recent convictions on Tuesday. When we asked CA Rutherford what the sentencing range might be he said “The maximum possible sentence is life in prison. I want to be clear that any crimes such as these against a child, I will always seek the maximum sentencing possible.”
