BOARD OF SUPERVISORS

Present: Mr. Allen Hale, Ms. Connie Brennan, Mr. Tommy Bruguiere, Mr. Tommy
Harvey and
Mr. Joe Dan Johnson

RESOLUTION/VA STORMWATER MANAGEMENT PROGRAM – Supervisors considered a
resolution expressing concerns with the draft regulations as follows:

1. The existing Erosion and Sediment Control and Stormwater
Management Regulations are not uniformly enforced across the state and
asking how the proposed new regulations will be implemented and enforced
uniformly;
2. The proposed regulations and the existing stormwater management
handbook do not provide for flexibility in the design of measures to manage
stormwater even if it can be shown through sound engineering design and
study that the system will work as designed;
3. Nelson has worked for the past decade to encourage economic
development for industrial, commercial and affordable residential growth in
a manner that does not impose unnecessary, burdensome regulation and
taxation. The Board believes that the proposed regulations will have a
significant impact by unnecessarily increasing the costs of development when
there are other less costly alternatives that could be used;
4. The proposed regulations will significantly reduce the ability of
the Nelson County Community Development Foundation and Habitat for Humanity
to construct affordable housing for low to moderate income residents of
Nelson;
5. The proposed regulations appear to discourage smart growth and
further sprawl into the rural areas;
6. The proposed statewide fee schedule will be detrimental to
development in Nelson. The proposed fees could prevent the prospective
homeowner from obtaining financing for a home and discourage larger
commercial and industrial development in rural areas where this type of
growth is necessary for the economic stability of these communities; and
7. The county would like to see one program for erosion and sediment
control and stormwater management with one handbook for planning and one
fee. The fee should be set by the local government at the actual cost for
administering the program in their area.

Supervisors voted 4-0 (Mr. Harvey absent for this vote) to adopt the
resolution.

RESOLUTION/PUBLIC HEARING ON DISPOSITION OF PROPERTY – Supervisors voted 5-0
to adopt a resolution authorizing a public hearing on Tuesday, September 8th
at 7:30pm on the sale of the former Rockfish Valley Elementary School to
Rockfish Valley Community Center.

SOLID WASTE/COLLECTION SERVICES FOR NELSON COUNTY PUBLIC SCHOOLS – Mr.
Carter and Ms. McSwain both reported that the schools currently have six
Waste Management cans (4 at the high school and one at each elementary
school); one recycling can at the high school as well as two county
recycling cans (1 at each elementary school). The county has proposed taking
over the solid waste collection program at the schools for the cost savings
and to improve the overall service. The proposal is for 4 cans (3 at the
high school with one swap-out can and eliminating the one at the Bus
Garage); one recycling can at the high school and utilizing the recycling
cans at the elementary schools for solid waste collection. The savings would
be $21,000 per year which would pay for the purchase of the four cans in a
little over a year. After discussion of the School Board’s refusal of the
proposal, Ms. Brennan and Mr. Harvey agreed to work with the School Board
and staff to come to an agreement.

CORRESPONDENCE/PLANNING COMMISSION RE COUNTRY STORES – Supervisors reviewed
a letter from the Planning Commission which noted a study that reviewed the
historic country stores in the county, noting their locations, zoning and
uses. The Commission, after review of the study, recommended to the
Supervisors that a separate ordinance related to country stores is not
needed at this time. Mr. Bruguiere said that he went along with the vote but
disagreed with the decision, noting that the purpose was to allow anyone who
has one of the old stores to be able to bring it back to life without
jumping through hoops. Mr. Boger said that the survey showed that the
majority of the stores were in Agricultural (A-1) so the Commission
determined that an ordinance was not needed. Mr. Hale said that most of the
stores are spread around the county and in A-1 and that he agrees with the
Commission’s recommendation. Mr. Harvey said that he would like to see the
study and discuss the issue.

meeting.)
